Terms and Conditions

We are Daniel & Company (Gifts) Limited, trading as Sanrio Gift Gate Online Shop (collectively "we", the "Company" or "Our site") .Our site provides a convenient way to shop online (including by using our applications or software). By using our site, you agree that you agree to be bound by the following terms and conditions. We reserve all our rights, from time to time, to amend the Terms and Conditions hereof without giving further notice to you.  
 
1 Order 
1.1All the listed merchandises on our site are regular priced items and no special discount of whatever kinds shall be offered. Product and the price at the product page at our site are for reference only and subject to alteration or modification at the time of actual transaction (if any).
1.2You should provide complete and the updated information including without limitation about your name, contact number, email address, delivery address and receiver name and etc.
1.3Subject to the terms herebelow, changes, cancellation, refund and/or exchange by you is not allowed upon placing the order and payment has been made.
1.4We reserve our right to cancel or not to accept an order for any reasons at our sole discretion, including without limitation:
1.4.1No sufficient stock to deliver the merchandise you have ordered;
1.4.2No delivery can be arranged;
1.4.3One or more of the merchandise you ordered was listed at an incorrect price or the wrong calculation of the grand total due to a human or computer error or an error in the pricing information provided by the supplier; or
1.4.4Merchandise wrongly and inadvertently ordered.
1.5We reserve our right to cancel the order if it is not trustable.
1.6After receiving your order, we will acknowledge receipt of your order by sending an email to you. However, it does not confirm that we have accepted your order.
1.7The acceptance of Orders is subject to the availability of stocks. If you order is accepted by us, we will confirm with you accordingly by issuing an email to you on the merchandises to be delivered. Once you have made payment, the delivery address shall no longer be changed. If we cannot supply any ordered merchandise(s) (whether partially or completely) or due to uncompleted payment through the use of your credit card or due to any other reason, we reserve the right not to accept your order and will, before delivery, inform you first by phone and thereafter via email.
1.8If only part of your order or whole of your order cannot be accepted, we will either refund the relevant amount of the money paid by crediting into your Paypal/Payme/Stripe/Apple Pay/GooglePay/Alipay or allow you to change to purchase other merchandises with higher or equal aggregate value.

2 Price and Payment
2.1 We only accept  Apple Pay(if Applicable)、Google Pay(if Applicable)、PayPal、Payme、VISA 、Master Card、 AlipayHK and all merchandises are quoted in Hong Kong Dollars.
2.2 We use third party payment service to process online transactions. When you place an order, you agree and accept that your credit card information will be collected, processed, and kept by us and a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making Apple Pay((if Applicable)、Google Pay((As if Applicable)、PayPal、Payme、VISA or Master Card 、 AlipayHK and in no event shall any such losses in whole or in part be borne by us.
2.3 Our site does not collect or keep your credit card/bank account information. If you choose to save your Apple Pay((if Applicable)、Google Pay((if Applicable)、PayPal、Payme、VISA、 Master Card 、 AlipayHK  account information for express checkout, you agree and accept that the information will be encrypted and stored by the third party payment service providers.

3 Delivery
3.1Unless you elect to pick up the Ordered and confirmed merchandise at our designated Redemption Center (please refer to Clause 3.8 below for costs required), they will be delivered to your designated address by a Third Party Courier (SF Express is the current appointed courier and we reserve the right to use another courier to deliver to the delivery address without giving any notice to you). We reserve our right to levy extra delivery charge or cancel the order if you fail to receive the order for any reasons.
3.2Third party delivery services are currently not available to addresses located in the following areas: (1) outlying islands, including AsiaWorld Expo, Disneyland, Lamma Island, Cheung Chau and Peng Chau (except Ma Wan, Discovery Bay, Tung Chung and Airport), and (2) restricted districts and areas that vans cannot access.
3.33.3 Delivery services shall cease during typhoon signal No.8 or above, or a red or black rainstorm warning is hoisted.
3.4If Typhoon Signal No. 3 or below, Amber, Red or Black Rainstorm Warning is issued, Third party service centers and Third party stores will operate as usual. If Typhoon Signal No.8 or above is issued, services of Third party service centers and Third party stores will be suspended immediately. You shall look out on the weather forecast and make proper arrangement.
3.5Subject to the terms and conditions hereof, we will use reasonable effort to arrange to deliver the ordered merchandise to you within the next 3-5 working days if we receive your order on or before 9am of each working day. However, the time of delivery shall be subject to the approval by the Third Party Courier. 
3.6Once the ordered merchandise has been delivered to your delivery address, they will be held at your own risk and we will not be liable for the loss or damage. The title to the ordered merchandise shall remain with us until you or the relevant financial institution has settled the price of the ordered merchandise.
3.7Our company will not be liable for any direct or indirect losses or damages arising in contract, tort or otherwise from the defective quality of the merchandise or the mis-description of the ordered merchandise as set out in this web site, exceeding of the retail price of the ordered merchandise.
3.8Subject to Clause 3.2 above, Ddelivery fee in the sum of :
(a)HKD$ 40 for each order to be delivered within Hong Kong SAR or HK$20 if delivered to our designated Redemption Center shall be levied if the order amount does not achieve HKD$400 or HKD$200 respectively (excluding specific or special priced items);
(b)HKD$ 50 for each order to be delivered to Macau SAR shall be levied if the order amount does not achieve HKD$500 (excluding specific, special priced items and large size items); and
(c)HKD$80 for each order of large size items (regardless of the order amount) to be delivered to Macau SAR will be levied. 
3.9Delivery fee for split order
If your order include pre-order merchandise, please noted that all the merchandises will be delivered after the arrival of all the pre-order merchandises. If you choose to split the order, an additional delivery for the split order will be levied in accordance with the terms hereof. For details, please refer to the table of delivery fee for split orders.

3A Pick Up At Our Designated Redemption Center 

(i) The current designated redemption center is EASY TRADE Redemption Centre (“designated Redemption Center”);
(ii) HKD20 for each order, if delivered to our designated Redemption Center shall be levied, if the order amount does not achieve HKD200 (excluding specific or special priced items);
(iii) The customer will be required to collect the shipment within fourteen (14) working days after receipt of our email notification. Failure to collect it within the stated period, each shipping order shall be subject to extra HKD50 delivery fee being the expenses to be spent on re-delivering the ordered merchandise.

3B Lapse of Time
Ordered merchandise that are not picked up within specified time or SF fails to reach you, your ordered merchandise might be charged additional storage fee by SF. If you fail to pick up the ordered merchandise within specified period for any reason, it will be treated as discarded merchandise (“discarded merchandise”) and handled in the following way. We shall not be responsible for any consequences arising from the discarded merchandise, including failure to receive the discarded merchandise at the end (whether due to shortage of goods or being destroyed) or any other loss suffered AND we reserve a right to claim for indemnification of any expenses incurred therein. 

(i) SF

If the ordered merchandise has not been picked up due to lapse of time and returned to us or needs to be re-delivered to another address, such as SF Store, SF Express Service Center, etc., the cost incurred for the return or the second delivery (if any) shall be borne by the customer.
Please contact SF (which contact information is set out below) immediately for necessary arrangement. 
Otherwise, the discarded merchandise will be automatically returned to our Company without further notice.
The discarded merchandise shall be dealt with in accordance with the provisions below after the discarded merchandise has been returned to our Company. (Please refer to Clause 3B (iii) below for more information.)

(ii) Designated Redemption Center- Handling

Upon the ordered merchandise’s arrival at the designated Redemption Center, an e-mail notification will be sent to you. 
If you do not collect the ordered merchandise within fourteen (14) working days, the discarded merchandise will be sent back to our Company. Please contact designated Redemption Center (which contact information is set out below) immediately for necessary arrangement.
The discarded merchandise shall be dealt with in accordance with the provisions below after the discarded merchandise has been returned to our Company. (Please refer to Clause 3B (iii) below for more information.)

(iii) Post-Return

After being returned to our Company, we shall keep the discarded merchandise in the storage for seven (7) days and reserve a right to levy a storage fee on a daily basis. You should, during such period, contact our Customer Service Officer for necessary arrangement.
If you elect for re-delivery (including through SF or Designated Redemption Center), we will additionally charge (1) HKD50 being the administration fee for re-delivery and re-delivery charge; and (2) storage fee (if any). The discarded merchandise will only be re-delivered after you have settled the above fee.
If we do not receive any notification from you during such period, you will be deemed to have finally decided to abandon the discarded merchandise. Our Company shall, without further consulting you, have the full discretion to deal with the discarded merchandise (including disposal or re-sell) without any compensation and also reserve the right to claim against you for the recovery of any losses suffered by our Company thereof (if any).


4 Refunds and exchanges
4.1Ordered merchandise may be returned for refund or replacement or exchanged(provided that we reserve the right to choose which way) within seven(7) business days of receipt if the merchandise you ordered are faulty, defective or damaged and not caused by you or the merchandise are not what you ordered, provided that:
4.1.1the merchandise are unused and in the condition originally sold together with all parts and accessories which are provided with the merchandise including manuals, certificates, labels, tags, consumables, bags, and boxes, etc.
4.1.2Supporting document (e.g. electronic receipt) to prove that merchandise(s) in problem is/ are purchased at our site;
4.1.3Sending us the photos(Total 6 photos: include front, back, left ,right, top and bottom) or movies of the merchandise(s)in problem through email immediately;
4.1.4After received the required information, our company shall follow up the case based on the related procedures.
4.2If the merchandise(s) in question is/are out of stock, we would refund to you or exchange for other merchandise(s).
4.3To exchange for another merchandise(s), the exchanged merchandise(s) must be available to purchase on our website and its/their aggregate price must be higher or equal to the original order amount (Provided That you shall separately settle any deficiency). If the discount offer is offered by a 3rd party, the exchange shall be subject to the relevant terms and conditions of that 3rd party.
4.3.1If you have purchased any items with any discount offered by promotional activities but the discount offer has expired at the time of the exchange, the discount shall not be taken into account. 
4.3.2 If the discount offer is offered by a 3rd party, the exchange shall be subject to the relevant terms and conditions of that 3rd party.
4.4Delivery fee will not be refunded, if any.
4.5Refund: Credited back the relevant net purchase price to the same PayPal,Payme, , Apple Pay、Google Pay, Alipay HK,Bank Transfer account within four (4) weeks after customers return the items to us via delivery through S.F. Stores at our own costs.
4.6Delivery cartoon box is solely used for the purpose of delivery and does not form part of the ordered merchandise or its packaging. We will not provide any after sale service nor arrange for refund nor arrange for exchange in relation to the delivery label, damage or defect of the said delivery cartoon box

5 Intellectual Property
5.1All intellectual property rights in the content, trademarks, product names and company names or logos, user content, design, text, graphics and other materials on our site are not permitted for you to use or change. 

6 Disclaimer 
6.1The company and its employees, contractors and any third party provider make no representation or warranty in relation to:(including using our applications or software to enter into our Website or any part of it)
6.1.1our Website will be uninterrupted, reliable or fault-free
6.1.2any express or implied warranty or representation or any kind of the accuracy or completeness of our Website 
6.1.3We do not have any responsibility and assumes no liability for any damage or injury arising out of use or browse of this website, or any failure, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, failure of communication lines, interception of transmission messages, software or hardware problem (including but not limited to loss of data or compatibility problems), theft, destruction or alteration of the website, or any breach of contract, tort, negligence, or any other complaints arising directly or indirectly from using or browsing this website, or from uploading, downloading or posting any data, words, images or other materials or information to or from this website.
6.2We will not be liable or pay any money to you for any indirect or consequential loss, damage or expenses, including loss of profits, business or goodwill, arising out of any problem you notify to us.

7.1.2Save or collect others' personal information
7.1.3use our site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others or breach any local, national or international laws or regulations or infringe the intellectual property rights or rights of the others
7.1.4transmit or otherwise make available in connection with our site any virus, or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software, or equipment;
7.1.5Transmit, copy or reproduce any parts of our site for any commercial purpose,;
7.1.6without our written consent, to copy or forward or dispatch any part of this site by whatever means or acquire any content of this site and which is copyrighted; 
7.1.7Disrupt others

8 Force Majeure
If the performance by our company of its obligations relating to the services it supplies on this site is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of the Government of the Hong Kong Special Administrative Region or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of our company), our company shall be excused from such performance to the extent of such prevention.

9.1We are not liable or take any responsibility for any error or mistake on the content for our site.
9.2We assume no responsibility and shall not be liable (to the extent permitted by law) for any damage or injury arising out of any use of visit our site, with any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software or hardware problems (including without limitation loss of data or compatibility problems), theft, whether for breach of contract, tortious behaviour, negligence or, under any other cause of action by any methods to access our sites.
9.3The Disclaimer contained in the website shall be governed by the laws of Hong Kong Special Administrative Region. Both parties agree to the non-exclusive jurisdiction of the Hong Kong Special Administrative Region courts.
9.4We reserve our rights to reject any visitors without any notice.
9.5Neither party shall be entitled to rely on any agreement, understanding or arrangement that is not expressly set forth in these terms and conditions.

10 Membership
10.1You are required to register with us when you use the services or place an order. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract.
10.2You must provide us with accurate, complete and updated registration information; you must inform us when there is any change of the registration information.
10.3If you, upon registration, provide your membership information of Sanrio Fans Club, you shall be deemed to have consented to our collect and use of your personal information held in Sanrio Fans Club for direct marketing and Sanrio Fans Club membership related purposes.   
10.4If we have reasonable grounds to suspect that any information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration.
10.5We respects your legal rights of privacy and collect and save the data based on the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (the "Ordinance") of the Laws of the Hong Kong Special Administrative Region.

11.7Direct Marketing

11.7.2You may opt out (free of charge) from receiving direct marketing communications at any time in writing by post to the address stated in paragraph 10  below or by other means stated in our company's websites from time to time.
11.8Security of Personal Data

ii.If our company has a contract with another third party organization to provide a service on its behalf, our company will ensure they have appropriate security measures and only process your information as our company has authorized.
